Evergreen Pet Cleanup - Terms of Service

Welcome to Evergreen Pet Cleanup! We are a locally rooted business in Oregon City dedicated to keeping your yard clean, safe, and odor-free. By enrolling in our services, you (the "Customer") agree to the following Terms of Service.
1. Description of Service
Evergreen Pet Cleanup provides weekly residential pet waste removal services billed monthly in advance. Our standard service includes:
- A thorough scouring of the designated yard area to locate and remove visible pet waste.
- A gentle residue rinse of areas where waste was present.
- Enzyme treatment of areas where residue is present.
- Application of professional-grade, non-toxic, pet-safe enzyme treatments to neutralize odors and break down residue as needed.
- Double-bagging of all waste and disposal in the Customer’s on-site trash bin.
2. Service Area and Lot Size
Plans are priced based on standardized lot size tiers for residential properties only. I confirm this is a single-family residential yard. (Note: For HOA common areas or commercial properties, please contact us for a custom quote.) If an order is placed through the website for a non-residential property at a residential rate, Evergreen Pet Cleanup reserves the right to cancel the order and issue a refund.
3. Dog Count and Plan Tiers
Most plans are priced according to the number of dogs regularly utilizing the yard:
• Single Pup Plan: Covers one (1) dog.
• Double Dog Plan: Covers two (2) dogs.
• Pack Leader Plan: Covers three (3) or more dogs.
• Large Yard Plan: Priced by lot size only (applicable to properties with a service area greater than 1/4 acre).
Any 7-day free trial offered under these Terms applies equally to all plans listed above. If Evergreen Pet Cleanup identifies additional dogs present beyond the enrolled plan, we reserve the right to adjust the subscription.
4. Pet Containment and Safety
For the safety of our technicians and your pets, all dogs must be secured indoors during the scheduled service time. If pets are present in the yard upon our arrival, the service may be skipped and billed at the full scheduled rate.
4.1 Gate Security: Our technicians will make every effort to ensure gates are latched and secure upon departure. However, it is the responsibility of the property owner to verify that gates are properly closed before releasing pets back into the yard.
5. Access and Yard Conditions
Customers must provide safe, unobstructed access to the service area. Service may be skipped and billed if gates are locked or access is blocked. Evergreen Pet Cleanup is not responsible for pre-existing yard damage or hidden hazards. Property owners are responsible for any technician injuries resulting from undisclosed hazards on the premises.
6. Enzyme Treatment
Enzyme treatments are pet-safe and non-toxic; however, Customers are advised to allow treated areas to dry completely before allowing pets to re-enter the area.
7. Weather Policy
Service may be delayed due to extreme weather conditions deemed unsafe by our team. In the event of a delay, waste accumulation will be handled during the next scheduled visit. No credits or refunds are issued for weather-related delays.
7.2 7-Day Free Trial
New residential customers may be eligible for a seven (7) day free trial. The Trial includes one (1) thorough yard cleaning and one (1) residue rinse. Customers may cancel at any time before the Trial ends to avoid being billed for the regular monthly service. All provisions of these Terms apply fully during the Trial.
8. Billing and Cancellation
Subscriptions are billed monthly in advance and renew automatically. To cancel service, email info@evergreenpetcleanup.com at least five (5) days prior to the next billing date. Monthly charges are non-refundable. Upon cancellation, service continues through the end of the current billing cycle.
9. Right to Refuse Service
Evergreen Pet Cleanup reserves the right to refuse service due to unsafe conditions, aggressive animals, or non-payment. We reserve the right to document yard conditions via photography for internal records.
9.1 Marketing: We reserve the right to use anonymous photographs of the service area for promotional purposes.
10. Limitation of Liability
The liability of Evergreen Pet Cleanup for any claim is limited to the amount paid by the Customer for the most recent billing period. We are not liable for incidental or consequential damages.
11. Governing Law
This agreement and all services provided shall be governed by and construed in accordance with the laws of the State of Oregon.
12. Agreement of Terms
By enrolling in and paying for services provided by Evergreen Pet Cleanup, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
14. Entire Agreement
This document constitutes the entire agreement between the Customer and Evergreen Pet Cleanup. Any changes to this agreement must be made in writing.
